KISMET COWORK Membership Agreement & Community Guidelines

Community

Be Considerate - Kismet is a shared community space. Treat others and the space how you would like to be treated. If you use something, put it back the way you find it. Leave your space clean and inspire others to do the same

Make Time to Connect - Get to know your fellow KISMET community team members. We value all of the knowledge our members bring into our spaces and want you to learn from and connect with everyone around you

Cleanliness - Members are expected to keep offices, desks and common areas clean. Dirty dishes, desks and restrooms distract from the positive experience we wish to provide all members.

Phone Calls - Calls in communal areas are permitted. Please consider your tone, volume and subject matter when in these spaces and use a phone booth if you feel others might be disturbed

Access & Security

Key Fobs - Key Fobs are not to be shared with anyone other than the KISMET member listed on your membership account. Sharing key fobs without explicit permission from KISMET may result in permanent banning from KISMET spaces or additional fees to your membership.

Visitors - Any visitors must be signed in at the front desk and accompanied by a Kismet member at all times. Each member is responsible for the actions of their visitor. Please use your judgment when considering the impact your visitors will have on the space and provided amenities.

Personal Property - Each member is responsible for their own equipment and belongings and expected to treat the property of others with respect.

Front Desk - a KISMET team member will typically be available at the front desk from 10:00am - 3:00pm

  • 24/7 Access - Members from the Floating Desk membership and higher have 24/7 access via key fob to the KISMET space. Please keep KISMET spaces secure by refraining from propping open doors, passing along your key fob to non-members or letting in unknown visitors. Emergency numbers are posted at the front desk

Services/Amenities

Mail - Please be advised that, excluding Community Plan members, KISMET members can receive business-related mail and packages at our locations. A KISMET team member will accept and distribute mail and deliveries on your behalf during regular business hours. However, it's important to note that KISMET cannot hold mail or checks for pickup at the front desk. Additionally, KISMET is not obligated to store mail and deliveries for more than 30 days or after a membership has been canceled. The acceptance of bulk or oversized packages is not guaranteed. Delays in shipment and delivery should be discussed directly with the shipper and not with a KISMET team member.

Internet - Please consider other community members if your work involves an excessive amount of bandwidth. Additionally, do not download, use or distribute any files or software that will disturb, disrupt or infringe any rights of our KISMET members.

Printing - In an effort to be environmentally friendly & respect resources, we ask that you do not print items that could remain a digital file. If printing, please opt to print in black and white before printing in color. Additionally, if your project exceeds 50 pages, we kindly ask that you take the project to an outside printing service such as Staples or Fedex.

Conference rooms - Conference rooms are available for booking by Floating Desk, Designated Desk, and Private Office members, with the allotted hours determined by your membership level: Floating Desk (2 hours), Designated Desk (4 hours), and Private Office (6 hours). Rates for the 1st floor conference room are $75 per hour, while the 2nd floor conference room is priced at $100 per hour. Each room is equipped with a TV featuring tech connection instructions, office supplies, and large whiteboards. We encourage you to consider a 15-minute buffer at the beginning and end of your reservation. Additionally, we kindly request that you use your discretion when booking and add extra hours if you anticipate your meeting running overtime or if you need additional set-up time. Please leave the conference room in the same condition you found it; a $75 charge will apply for subpar conditions.

Kitchen/Food & Beverage - Communal snacks and drinks are available and included in your KISMET membership (coffee/tea, water and light snacks). Please treat all kitchens and service areas as if they are part of your own home, kindly utilizing the dishrack and dishwasher for all dirty dishes. Should any confusion arise, please consult a KISMET team member. The fridge is open to all members and will be cleaned out regularly by a KISMET team member.

Office/Desk Decor -Please ensure that offices and desks are restored to their original state at the conclusion of your membership. Design elements should not be permanently installed or cause damage to walls or surfaces at designated desks. If you wish to customize a private office with features like painting, wall hangings, or window/door decals or curtains, a refundable $500 deposit is required. This deposit will be returned upon completion of the move-out process and the restoration of the space to its original condition. Prior to adding any storage or decor, kindly consult with a KISMET team member for guidance.

Cleaning Services: Enjoy routine cleaning and maintenance for shared spaces. Offices will be vacuumed by our cleaning staff twice monthly. To request any additional office cleaning, kindly email officemanager@kismetcowork.com, and we will add a $50 cleaning fee to your next month's invoice. For trash removal, please place your trash can outside of your desk or office space.

Key Fob and Key Policy: Each member will be issued 1 key fob. Private office members receive 1 office key as well as 1 key fob. Additional key fobs for employees can be obtained for a monthly rate of $100 per fob.. Members are limited to a maximum of 2 keys and 2 key fobs. Key fob holders must be listed on the member's account. Upon membership termination, please return keys and key fobs to the bin labeled Keys & Key Fobs at the front desk with a sticky note including your name. Lost or unreturned key fobs will result in a $250 charge invoiced to the member.

Adding Members to Your Private Office Membership

  • If you require an additional person or employee to be included in your membership for private offices (2 total members maximum per account), there is an extra charge of $100 per month. This fee aligns with the aforementioned additional key fob fee. With this addition, both individuals will be provided with a keyfob and key for office access, along with access to coworking office, kitchen, and conference room resources. Please note that conference room credits are allocated per office, not per person.

Payments, Invoicing, Late Fees

Payments - Unless otherwise stated, payment for the month is due on the first of the month. KISMET prefers auto payment via card through our Nexudus site, though prompt payment by ACH is also accepted.

Invoicing - Invoices will include your membership fee, plus any additional fees incurred during the previous month. The most common of these fees is a booking fee for a conference room if you've gone over your allotted complimentary conference hours.

Late fees - A late fee of $50 will be added to an invoice 7 days past the initial due date, which in most cases is the first of the month. KISMET reserves the right to change fees at any time.

Membership Cancellation Notice: To cancel your membership, you are responsible for providing us with one full calendar month's notice, and your lease will end at the end of that calendar month. Once your notice is received, your contract will be terminated for the following month.

Membership Changes-

  • To make changes to a month-to-month contract, such as transitioning to a different membership level or terminating the contract, written notice must be submitted by the 1st day of any calendar month, with a mandatory minimum of 30 days for the changes to take effect.

  • For 12 month contracts, KISMET reserves the right to charge an early termination fee of $250.

  • When an office agreement concludes, it is imperative to vacate the accommodation immediately, restoring it to its original state. Any property left in the center may be disposed of without any responsibility owed to you for the items or any proceeds of sale. Please ensure all personal belongings are removed from the space and returned to its original condition by the last day of the calendar month. If any repairs are needed, a $150 fee will be included in the final invoice.

TERMS AND CONDITIONS OF MEMBERSHIP A stable, safe, and clean coworking space is vital for its use to our members. By joining our community you agree that, at any time, your rights or privileges under this agreement may be irrevocably and immediately canceled should your actions, inactions, activities, or behavior constitute an unsafe, unsanitary, disorderly, threatening or hostile work environment, or violate the terms of our lease, with the absolute and sole discretion of Kismet management.

Upon such a cancellation, you agree to surrender any and all keys or access cards to the coworking space, and forfeit any and all remaining balances held by Kismet and waive any and all claims to the remuneration of any balances.

All members are responsible for their own actions and belongings including intangible properties, both intellectual and technological. Additionally, all members are responsible for their guests’ behavior, belongings and safety while they are in our space. Kismet agrees to maintain reasonable security measures: controlled access, security camera, protected Internet connection, and a requirement that all members maintain updated anti-virus software on any computer they use in our space. Still, if you or your properties are injured by the actions of others, you agree to pursue claims against them and not against Kismet. If Kismet’s own actions cause you or your property harm, your sole remedy is to terminate your membership and recover your actual damages, not to exceed one month's membership fee.

We strongly recommend that you obtain appropriate insurance coverage for your belongings, either through a tenant’s insurance policy, a corporate general liability policy, or your homeowner’s policy. (The credit card authorization form that you sign when you become a member should be sufficient to establish insurable interest in your property while it is at KISMET).

We're saying that you're responsible for your things and actions. You expressly agree that this Coworking Member Agreement is not a lease in any fashion (commercial, residential or otherwise) and therefore also expressly waive any and all rights, privileges, immunities, and due process protections afforded by the landlord/tenant laws of the City of Philadelphia and the Commonwealth of Pennsylvania. You agree to indemnify Kismet from any and all civil or criminal actions arising from your use (or misuse) of the coworking space. We're saying that we are your colleagues, not your landlord. Continuing to enroll signifies that I have read, understood and will comply with the above during my time as a member of Kismet’s Cowork Program.
